Terms of Service

1. Acceptance of Terms

By accessing, browsing, or using the products and services provided by LeadFuze, specifically including the Identity Resolution Pixel ("IDRP"), Data Enrichment services, and Data Licensing (collectively, the "Services"), you ("Customer", "User", or "You") agree to be bound by these Terms of Service ("Terms").

If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these terms. If you do not have such authority, or if you do not agree with these terms, you must not accept these Terms and may not use the Services.

2. Description of Services

LeadFuze provides data intelligence solutions including:

  • Identity Resolution Pixel (IDRP): A technology service enabling the identification of website visitors.
  • Enrichment Services: An API and portal-based service that appends business intelligence data to provided inputs.
  • Data License: Access to LeadFuze's proprietary database of business and professional profiles.

3. Billing, Payment, and Cancellation

3.1 Portal-Based Billing

All billing and subscription management is handled directly through the LeadFuze customer portal. You agree to provide current, complete, and accurate purchase and account information for all Services via the portal.

3.2 IDRP Specific Billing

Usage of the Identity Resolution Pixel is billed on a per-website basis as defined in your subscription plan. Adding the pixel to multiple domains may result in separate billing events or aggregated usage charges as specified in the portal.

3.3 Cancellation Policy

You are solely responsible for cancelling your subscription or projects. Cancellation must be performed through the "Settings" or "Billing" section of the LeadFuze portal. LeadFuze does not accept cancellation requests submitted via email, phone, or chat. Failure to cancel via the portal prior to the renewal date will result in automatic renewal charges.

3.4 No Refunds

ALL PAYMENTS ARE NON-REFUNDABLE. LeadFuze does not provide refunds or credits for any partial subscription periods, unused credits, or unused data.

4. Relationship with Signed Agreements

In the event You have executed a separate, written Data Licensing Agreement or Enterprise Contract (a "Signed Agreement") with LeadFuze, the terms and conditions of that Signed Agreement shall supersede these Terms of Service to the extent of any direct conflict. These Terms shall continue to apply to any Services or usage not covered by the Signed Agreement.

5. Acceptable Use Policy (AUP)

LeadFuze promotes responsible use of our network, systems, and data. By using the Services, You consent to be bound by this AUP. LeadFuze reserves the right to modify this AUP at its discretion.

Prohibited Conduct: You agree NOT to use the Services for any of the following:

  • Illegal Activities: Any activity that violates applicable federal, state, local, or international law or regulation.
  • Malicious Content: Transmitting, distributing, or storing any material that contains viruses, time bombs, trojan horses, worms, malware, spyware, or any other programs that may be harmful or dangerous.
  • Email Abuse: Sending unsolicited mail messages ("spam"), including, without limitation, commercial advertising and informational announcements, or "mail-bombing".
  • Header Forgery: Forging any TCP/IP packet header or any part of the header information in an email or newsgroup posting, or otherwise engaging in identity spoofing.
  • Security Violations: Unauthorized access to systems, networks, or data; attempting to breach security or authentication measures; or interfering with service to any user, host, or network ("Denial of Service" attacks).
  • Network Sabotage: Any activity which threatens the integrity or availability of the LeadFuze system or any other system or network.
  • Prohibited Content: Transmitting content that is obscene, defamatory, threatening, abusive, hateful, or incites violence.

Enforcement: Violation of this AUP may result in immediate suspension or termination of your account and access to Services without refund. LeadFuze reserves the right to involve and cooperate with legal authorities and system administrators in the investigation of any AUP violations.

6. Account Security

You are responsible for maintaining the confidentiality of your account credentials, API keys, and portal access tokens. You are fully responsible for all activities that occur under your account. You agree to immediately notify LeadFuze of any unauthorized use of your account or any other breach of security.

7. Intellectual Property Rights

All intellectual property rights in the Services, the LeadFuze database, the IDRP technology, and the API are owned by LeadFuze or its licensors. Subject to your compliance with these Terms and payment of applicable fees, LeadFuze grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. LEADFUZE EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. LEADFUZE DOES NOT WARRANT THAT THE DATA PROVIDED WILL BE ACCURATE, COMPLETE, OR ERROR-FREE.

9. Limitation of Liability

IN NO EVENT SHALL LEADFUZE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (iii) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

10. Modifications to Terms

LeadFuze reserves the right to modify these Terms at any time. We will provide notice of any material changes through the Service or via email. Your continued use of the Service following such notification constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
